How is information obtained by Lumension and how is it used?
We also receive and store certain types of information through use of “cookies.” A “cookie” is a string of information that a website stores on Your computer and Your browser provides to the applicable website each time You submit a query to the applicable website. Some examples of information gathered through the use of “cookies” are the Internet Protocol (IP) address used to connect Your computer to the Internet, log-in, email address, password, computer and connection information such as browser type and version, operating system, platform, and the full Uniform Resource Locator (URL) used to, through, and from our Sites. We use the information gathered by “cookies” to manage and customize Your online experience and to improve our offerings.
You may also submit technical information to Lumension such as designs, ideas or data that You transmit to or post on any of our Sites (a “Submission”). Submissions are considered and treated by Lumension as non-confidential and non-proprietary. By providing a Submission, You grant Lumension a non-exclusive, royalty-free, perpetual, irrevocable, sublicensable right to disseminate, display, use, modify, copy, adapt, and translate that Submission for any purpose whatsoever, whether commercial or noncommercial, throughout the world in any media. You also grant us the right to use the name You submit in connection with Your Submission, if we choose. You represent and warrant in making any Submission that You own or control all rights to the Submission, and that use of Your Submission will not cause injury to any person or entity including Lumension. You agree to indemnify Lumension for all claims resulting from Your Submissions.
We may also provide social media features through the Sites that enable You to share information with your social networks and to interact with Lumension on various social media sites. Your use of these features may result in the collection or sharing of information about You, depending on the feature. We encourage You to review the privacy policies and settings on the social media sites with which You interact to make sure you understand the information that may be collected, used, and shared by those sites.
We also may collect technical information from You or Your agents as described in the “Data sharing and remote assistance” section immediately below.
Lumension is a business-to-business solution provider. Generally, Lumension does not collect or retain, and does not wish You to provide to us, any personal data or personally identifiable information relating to Your company’s customers, Your company’s employees or any other individual person (“PII”). If You wish to provide PII to Lumension for any reason, including without limitation for purposes of using or supporting Your licensed Lumension software products, You must expressly inform Lumension in writing in advance that You intend to make such a disclosure.
Data sharing and remote assistance
You hereby agree that Lumension may collect, store and use technical information it receives from You or Your agents, for its reasonable business purposes that may include, without limitation, Product development, improving Lumension’s understanding of Your Use of the Product, enhancing Lumension’s Support efforts, and aggregating such data from our customers to identify industry and market trends and improve our combined offerings. Unless and until You have provided Lumension with express written notice to the contrary, You hereby agree: (a) that Lumension may use such technical data that You share with Lumension for the purposes set forth above, (b) to allow Lumension to provide You Support services via remote assistance, and (c) that Lumension may use functions within the Product to allow Lumension to collect such data through the Product and to perform remote assistance functions. You understand and agree that such data may include proprietary, confidential or user-identifiable data, and You represent to Lumension that You have obtained all necessary permissions to share all such data with Lumension. With respect to the sharing of certain data, Lumension may request that You “opt in” before collecting such data from You; in such instances and with respect to such data, the provisions of this paragraph shall apply only if and when You do opt in.
Collection of information by third parties
If You visit the Sites from a third-party website the third-party website may be able to access select information from Your individual transaction information. In order to track and credit Your transaction the third-party website may give You a unique code, cookie or graphic which will uniquely identify You. This will only happen if You link directly from a third party website to the Sites. Any transactions made at the Sites while such a code is active will be reported back to the third party website. We will only report information such as the date of the transaction, the product(s) purchased and the amount spent to these third party websites. We will not report any information to these third party websites that will allow them to personally identify You.
You may be asked to select a password in connection with the use of the Sites or our products. You are responsible for the security of Your password and You should not disclose your password to any third parties nor share it with any third parties. If the security of Your password has been compromised for any reason, You should immediately notify us and change your password.
How can I manage the information Lumension has about me?
You can always choose not to provide information to Lumension. However, if You elect not to provide information requested by Lumension You may not be able to take advantage of certain features of the Sites, including change notifications and literature updates.
You can set your browser to reject cookies or to notify you when you are sent a cookie. You can also purchase and download software that will allow you to visit the Sites without providing the information gathered by cookies. You are welcome to use the Sites if you use such software, but your experience while visiting the Sites may not be optimal.
Further, as noted above, You can opt-out of having Google collect information about You by changing Your preferences through the Google’s Ads Preferences Manager located at https://www.google.com/settings/ads/onweb/ or using the Google Analytics Opt-out Add-on located at https://tools.google.com/dlpage/gaoptout/.
With whom does Lumension share information?
Sharing of certain information is important for Lumension to be able to offer products and services to You. We do not sell, rent or lease customer information to third parties. We do share customer information with our worldwide subsidiaries and with certain third parties as described below. Our subsidiaries are, and such third parties may be, based in the United States or in other countries throughout the world. We are not responsible for the privacy practices of third parties to whom Your information may be transferred. If You do not wish us to share Your information as described below, You may opt out by not supplying information to us or by contacting us at Privacy@Lumension.com.
Distributors and sales representatives: These companies and persons sell to and often provide service to Lumension’s customers. They have access to customer information to do so].
Conformance with the law: We release account and other customer information when we believe it is appropriate to comply with the laws of the State of Arizona and the other jurisdictions in which we do business or in which our customers or business partners are located, as applicable.
Business transfer. In the event that Lumension is sold, has its assets acquired or transferred, whether voluntarily or involuntarily, or merges or becomes affiliated with any other division, individual or entity, any information owned or under the control of Lumension may be one of the transferred assets. We reserve the right, as part of such transaction, to transfer or assign the information we have collected from users of the Sites.
Lumension does not knowingly collect information from children under the age of 13 and does not target the Sites to children under the age of 13. We encourage parents and guardians to take an active role in their children’s online and mobile activities and interests.
Security of Your information
Lumension is committed to protecting the security of Your information. We use a variety of advanced security technologies and procedures to help protect Your information from unauthorized access, use, or disclosure. For example, we store the information You provide on secured computer servers, which may include hosted services, and any data that we may store in a public cloud setting is anonymized using a globally unique identifier (GUID). Additionally, when we transmit sensitive information over the Internet, we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol.
Law and jurisdiction
Transfers of information outside of Your country of residence
By using the Sites, You hereby consent to the collection, transfer, storage, processing, and other use of Your information outside of Your country of residence. You acknowledge that your information may be subject to the privacy and data protection laws that may not be the same as such laws and regulations in Your country of residence.
Special notice for users located in countries that are part of the European Economic Area
The information that we collect from You may be transferred to and stored at a destination outside the European Economic Area (“EEA”), and principally the United States. It may be processed by staff operating outside of the EEA who work for us or for one of our service providers. Such staff may be engaged in, among other things, the fulfillment of Your order, the processing of Your payment details and the provision of support services. By using the Sites, You hereby consent to the collection, transfer, storage, processing, and other use of Your information in the United States or other applicable jurisdiction. You acknowledge that Your information may be subject to the privacy and data protection laws and regulations of the United States or other applicable jurisdiction, which may not be the same as such laws and regulations in your country of residence.
